Terms of Service

Welcome to CastAMint (“CastAMint,” “we,” “us”). By creating an account or using the service you agree to these Terms and our Acceptable Use Policy. If you don’t agree, don’t use the service.

What CastAMint is. CastAMint turns a description or uploaded image into an AI-generated concept and then into a print-ready 3D miniature. Creating and previewing are free. You can pay to download the 3D file, order a physical print (resin/“full color,” FDM, or SLS nylon), or subscribe to a plan with a monthly cast allowance and perks.

Eligibility & accounts. You must be at least 13 (or the minimum digital-consent age where you live) to use CastAMint, and 18+ to make a purchase. Keep your login secure; you’re responsible for activity on your account.

Your content & your responsibility. You are solely responsible for what you create, upload, download, share, and print. You represent and warrant that you have all rights necessary to do so and that your creations do not infringe anyone’s copyright, trademark, right of publicity, privacy, or other rights. Do not generate brands, logos, or franchise/IP characters you don’t own, and do not use a real person’s likeness without their permission.

Ownership & license. As between you and us, you keep whatever rights you have in your original prompts, uploads, and the figures you create, subject to the terms of the AI providers we use. We claim no ownership of your creations. You grant us a limited license to host, store, process, and display your creations as needed to operate the service, and to show public figures in the community gallery. On the Free plan, figures you create are public by default and appear in the community gallery; paid plans default to private. You can change any figure between public and private, and delete your casts or account, at any time from My Casts.

AI output — no IP guarantee. Figures are produced by third-party AI models and reconstructed into 3D. The legal status of AI-generated output is unsettled and varies by country; in some places it may not be protectable by copyright at all. We do not guarantee that any output is original, free of third-party rights, or owned by you, and we do not grant you an intellectual-property license to AI output. Output may also contain errors, artifacts, or features that don’t print well — we make no guarantee of accuracy, quality, fitness, or printability. Review everything before you download or print.

Commercial use. On the Free and Hobby plans, creations are licensed for personal, non-commercial use. The Pro plan adds commercial use rights: you may sell physical prints of figures you create, provided you (a) actually hold the rights to the underlying content and (b) comply with the Acceptable Use Policy and the AI providers’ terms. “Commercial use rights” is our permission to use the service’s output commercially under these Terms — it is not a grant of intellectual-property ownership in the output, and it does not shield you from third-party IP claims. You remain fully responsible for ensuring you have the rights to sell what you make.

Termination. We may suspend, remove, or terminate content or accounts that violate these Terms or the Acceptable Use Policy, with or without notice. You may stop using the service and delete your account at any time.

Disclaimers & limitation of liability. The service is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, CastAMint and its suppliers are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of the amounts you paid us in the three (3) months before the claim or US $50.

Indemnity. You agree to indemnify and hold CastAMint harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms — including intellectual-property claims relating to what you create, sell, or print.

Changes & governing law. We may update these Terms; material changes will be reflected by the “last updated” date, and continued use means acceptance. These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there.

Acceptable Use Policy

Don’t use CastAMint to create, request, download, share, sell, or print:

• Content that infringes copyright or trademark — including characters, logos, or brands you don’t own (e.g. franchise/IP characters).
• A real person’s likeness without their permission (your own photo, or someone who has consented, is fine).
• Sexual content — and absolutely nothing sexual involving minors. We report suspected child sexual abuse material to authorities (e.g. NCMEC).
• Hateful, harassing, threatening, or violent content targeting people or groups.
• Functional weapons, weapon components, or anything designed to cause real-world harm, or anything otherwise illegal.
• Attempts to abuse, overload, scrape, reverse-engineer, or bypass limits, moderation, or billing of the service.

We screen requests automatically and may block, remove, or refuse content and accounts. Automated screening is not a legal review and is not perfect — you remain responsible for your creations regardless of whether they were blocked.

Billing, Subscriptions & Refunds

Payments. Payments are processed by Stripe; we don’t store your full card details. Prices are shown in USD and may change with notice.

Subscriptions. Hobby and Pro are billed monthly and renew automatically until cancelled. You can cancel anytime from Account → Subscription (Stripe billing portal); access and your monthly cast allowance continue until the end of the current paid period. Cast allowances reset each billing cycle and don’t roll over. We don’t provide pro-rated refunds for partial periods except where required by law.

Credits. Casting consumes credits/allowance. Credits have no cash value, are non-transferable, and are non-refundable except where required by law.

Digital downloads. Because a download is delivered instantly, all sales are final once the file has been generated or downloaded, except where required by law or if the file is defective.

Physical prints. Prints are made to order. FDM and SLS prints are produced in-house; “full color” prints are produced by our third-party manufacturing partner and may ship internationally first. Estimated lead times are estimates, not guarantees. Because items are custom-made, we generally can’t accept returns — but if your print arrives defective or damaged, contact us within 14 days of delivery with photos and we’ll reprint or refund it. Coupons and member discounts apply to item subtotals (not shipping) and can’t be exchanged for cash.

Privacy Policy

What we collect. Account info (email, optional display name); your prompts, uploaded images, selections, and generated figures; orders and shipping address (for physical prints); subscription/payment status (via Stripe — we don’t store card numbers); and usage/diagnostic events for billing, analytics, and abuse prevention. If you contact us, we keep your message and email.

How we use it. To provide and improve the service, generate and fulfill your creations and orders, prevent abuse, and communicate with you (transactional emails, and product/lifecycle emails you can opt out of). We do not sell your personal data.

Processors we share with. We share data only as needed with: Supabase (authentication, database, file storage), an AI image & text provider (generation and moderation), a 3D reconstruction provider, Stripe (payments & subscriptions), a full-color print manufacturing & fulfillment partner (receives your model and shipping details for those orders), an email delivery provider, and a hosting & analytics provider. Each processes data under its own terms.

Retention. We keep your data while your account is active. Deleting a cast removes it; deleting your account removes your profile and casts. Some records (e.g. order/payment history) may be retained as required for legal, tax, or fraud-prevention purposes.

Your choices & rights. You can view, edit, or delete your casts in My Casts and your account in Account → Profile (including full account deletion). Depending on where you live (e.g. EEA/UK or California), you may have rights to access, correct, delete, or port your data, or to object to certain processing — contact us to exercise them. You can unsubscribe from non-essential emails via the link in those emails.

Children. CastAMint isn’t directed to children under 13, and we don’t knowingly collect their data. If you believe a child has provided us data, contact us and we’ll delete it.

Security. We use reputable providers and reasonable safeguards, but no online service is 100% secure. Use a strong, unique password.

Copyright / DMCA

If you believe content on CastAMint infringes your rights, email support@castamint.com with “DMCA” in the subject and include: identification of the work; the URL of the infringing figure; your contact information; a statement that you have a good-faith belief the use is unauthorized; a statement under penalty of perjury that the information is accurate and you are authorized to act; and your signature. We remove infringing content promptly and terminate repeat infringers. If your content was removed in error, you may send a counter-notice to the same address.
